Guns Save Lives, et al. v. Kwame Raoul.

ILA Litigation Counsel informs:
This case, filed in Sangamon County, challenges the Illinois Firearm Owners Identification Card Act, which requires Illinois residents to secure a license and pay a fee in order to be permitted to own a firearm, even in their own homes.
The trial court denied the plaintiffs’ motion for preliminary injunction.  The plaintiffs appealed to the Fourth District Appellate Court.  The Appellate Court affirmed.
The court found that we had established all the element for a preliminary injunction, except that consideration be given to maintaining the status quo.  Since the FOID Card Act was originally passed in 1968, the court ruled that granting the injunction would not serve to maintain the status quo, and accordingly, the case was remanded to the trial court.
The case went back to the trial court, where, on October 23, 2020, the applicants filed a motion to amend the complaint and the defendants filed a motion to dismiss, which is pending.
On June 22, 2021, the Court stayed the case, “pending the outcome of People v. Brown, a separate case challenging the validity of the FOID ACT in the Illinois Supreme Court.  ...  After being stayed for several months, summary judgment briefing was completed in January, and oral arguments were held on April 19.  The court denied our summary judgment motion and granted the state’s motion on July 18.”
The plaintiffs have appealed that to the Fourth District Appellate Court.
